British Military Fitness Membership Terms and Conditions January 2012.

The terms of your contract with us.

These terms apply to all of our members.

1. Membership
Your membership will start from today’s date.

You will be a member for at least six full calendar months which is your minimum term. Your membership will continue automatically after your minimum term unless you give us at least five working days notice. Please read section 5 below.

2. British Military Fitness venues and classes
We currently permit members to attend classes at any British Military Fitness venue. Members not attending their ‘home’ venue must register their full name and home venue with the instructor upon arrival.

We will ask you to transfer your membership to the venue you use most in any three month period. You will have to pay the prevailing membership fees at the venue to which you transfer.

3. Class timetables
We change our timetable twice a year in line with the seasonal clock changes at the end of March and the end of October. We give you at least 30 days notice of any timetable changes affecting your home venue.

We may on occasion need to make additional temporary changes over and above seasonal changes to our class timetable. If possible we will notify you of our intention to do this. If our published classes are unavailable at your home venue or a venue within 20 minutes drive time for at least 20 days out of 60 you may be entitled to an appropriate refund.

4. About your membership fees
a. Joining fee
You will pay your joining fee and your first month’s pro-rated membership fee in your first Direct Debit payment. The first payment will be taken within 15 working days of your membership start date. All subsequent Direct Debit payments will be taken on the first working day of each month. The joining fee applies to all memberships. If you cancel and want to rejoin, the joining fee will still apply.

b. Monthly membership fees
You need to pay your full monthly membership fee in advance (for the month to come) by Direct Debit. This will be taken from your bank account on the first working day of every month.

c. Missing membership fee payments
If you don’t pay your membership fee on time, we or our processing agent will e-mail to tell you. You will be charged a one-off non-payment fee for this. You will not be able to attend classes until you have paid what you owe us.

If you still don’t pay, you are breaking this agreement. We could refer missed payments to a debt collection agency and claim compensation from you for an amount equal to the total membership fees, including fees you owe for the rest of the minimum term or if the minimum term has expired, the notice period.

d. Fee changes
We review our membership fees from time to time. We will give you at least one calendar month’s written notice of any such changes. If we increase your membership fees (excluding VAT) by more than the rate of inflation plus 5% in any six month period then you can cancel your membership by giving us five working days written notice.

e. Other charges
We may charge you up to £15 to cover our costs for the following:

  • Contacting you about failed payments
  • Putting your membership on hold and restarting it
  • Dealing with membership fees that are not paid by direct debit

5. Suspending, cancelling or transferring your membership
a. How to put your membership on hold
During the minimum term you can only put your membership on hold if you have a medical condition that stops you attending classes. The on hold period can be between one and twelve months, and we will need proof of your medical condition (such as a doctor’s certificate).

Once you return, we will add the period(s) when your membership was on hold to the end of your minimum term.

Outside your minimum term we may allow you to put your membership on hold once in any twelve month period for between one and three months.

We may charge a monthly fee for this service.

You can only put your membership on hold for full calendar months and must give us at least five working days written notice before the end of the month. Your membership will then be suspended from the first day of the following month. For notices received less than five working days before month end, membership will be suspended on the last day of the following month.

b. How to cancel your membership
If you want to cancel your membership you must give us at least five working days written notice before month end. Your membership will end on the last day of that month. For notices received less than five working days before month end, membership will end on the last day of the following month.

Notices received after 17.30 will be processed on the next working day.

If you notify us during your minimum term, your membership will finish at the end of that month or upon the expiry of the minimum term whichever is later.

You are responsible for ensuring that we have received your written notice.

(i) Cancellation for medical reasons, relocation or redundancy
We may allow you to cancel your membership before the end of the minimum term if you have been a member and:

  • Have a medical condition that stops you from attending classes
  • Relocate more than 20 minutes drive from any of our venues (as measured by AA Route Planner)
  • Are made redundant

We will need to see proof of these circumstances and also five working days written notice before month end. You are responsible for ensuring that we have received your written notice and proof of circumstances.

c. How to transfer your membership
Your membership is personal to you and cannot be assigned or transferred to another individual.

You can apply to transfer your membership to another venue. Membership at your new venue will start on the first day of the following month, and you will have to pay the prevailing membership fees at the venue to which you transfer.

If for any reason British Military Fitness decides to no longer run classes at your home venue you can transfer your membership to a suitable alternative venue straight away.

If there is no other suitable venue then you will be able to cancel your membership upon the closure of your home venue. If this is within your minimum term, you will not be expected to pay the remainder of your membership fees.

6. Our right to cancel your membership
We will cancel your membership immediately if you seriously or repeatedly:

  • Break these terms and conditions
  • Put the health, safety or wellbeing of other members or our employees at risk
  • Allow other people to use your membership to attend classes
  • Engage in disruptive or violent behaviour

7. Our responsibility to you
We are not legally responsible for any possessions you lose or that are damaged or stolen by anyone unless we have been negligent. If you have an accident or injure yourself at one of our classes you must report this to the instructor straight away.

8. Your personal information
We take our responsibility for looking after your personal information very seriously. You can find out how you can see the information we hold about you or how to ask us to change this information in our privacy policy which is on our website www.britmilfit.com

You are responsible for informing us about any changes to your personal information.

9. Changes to these terms and conditions
We may change these terms and conditions. We will give you at least 30 days notice to inform you of any significant changes that may affect your membership and also publish the updated terms and conditions on our website.
